When the property of stolen goods exceeds $3,000, or the property is an automated teller machine (ATM) or the contents of an ATM, Rochester prosecutors will charge you with Grand Larceny in the Third Degree (NY PL 155.35).
This is a class D Felony, which means you’re facing a sentence of up to seven years, with a minimum of one year, if you’re convicted.
You’ll also have to live with a felony record for the rest of your life, because New York doesn’t allow expungement.
All future employers, landlords, and others with real power over your life will have access to this information, and you’ll be excluded from many opportunities because of the conviction.
